Chopping down your tree removal questions

  • You can exercise the “right of abatement” to trim back to the boundary, but follow the law. Under Queensland’s Neighbourhood Disputes (Dividing Fences and Trees) Act 2011, you may prune back to your boundary. If branches overhang >50 cm and are ≤2.5 m high, you can serve a Form 3 notice for removal; for higher branches (over 2.5 m), you can apply to QCAT for an order. The qualified arborists as ECTW can help ensure the works follow the letter of the law, and help you document the work done for peace of mind.

  • Yes — don’t DIY near live lines. Energex advises contacting them for trees near overhead lines, especially when using machinery or if limbs are within clearance zones. Sunshine Coast Council notes that pruning within 1.3 m of a powerline must be performed by Energex; residents can request Council arborist assistance for street trees encroaching from public land. Plant “powerline-friendly” species and schedule professional maintenance with ECTW to maintain clearances.

  • No — not without a Council permit. Clearing or damaging vegetation on road reserves, footpaths or nature strips requires a Council permit under local law. Applications are assessed case-by-case; Council generally won’t approve removal for views or aesthetics. 

  • Yes — Noosa requires a permit to clear vegetation on all private land unless an exemption applies. Noosa Council regulates vegetation removal via Noosa Plan 2020. You must apply to remove protected vegetation and check the Biodiversity, Waterways & Wetlands Overlay. Penalties apply for unauthorised clearing. Skip the stress and let the team at ECTW handle the permit application process for you. 

  • Some emergency and fire-management clearing is allowed, but conditions apply. Council recognises emergency/firerisk works and refers to State accepted development vegetation clearing codes. You may need to notify the State before certain disaster-mitigation clearing and advise Council if works were directed by authorised fire officers. For storm season prep, get in touch with ECTW to book in for a quote.

  • Often yes — if the vegetation is “protected” under the Sunshine Coast Planning Scheme or other overlays. Tree/vegetation clearing is classed as operational work under the Planning Act 2017. You may need a council permit if the tree is protected by the Vegetation Management Code, biodiversity/wetlands overlays, covenants or previous development conditions. Our team of qualified arborists can help you get the permits needed for tree removal on your property. 

  • Yes — marine plants (including mangroves) are protected under Queensland’s Fisheries Act 1994. Trimming, lopping, removing or damaging marine plants (e.g., mangroves, seagrass, saltmarsh) usually needs State approval. 

  • Yes — Queensland law protects breeding places of native wildlife. It’s an offence to tamper with an animal breeding place being used by a protected animal (e.g., possums, birds) without authority. If works may impact a breeding place, you may need an approved Species Management Program (SMP) or other permits. Engage a qualified arborist from ECTW and, where needed, a fauna spotter-catcher before works to inspect hollows, nests and roosts. 

  • Steps:

    1. Run a Development site report to see if Biodiversity, Waterways & Wetlands overlays apply to your lot. 
    2. Check if your site has vegetation covenants, drainage easements or development conditions restricting removal. 
    3. If you’re in SEQ Koala Priority Areas or mapped koala habitat, stricter State rules may apply — even if Council supports removal. 
    4. If protected, you’ll likely need to lodge DA Form 1 for operational works (vegetation removal).
