  • Often, yes. Whether you need approval for land clearing on the Sunshine Coast depends on state vegetation mapping (remnant/regrowth categories), SEQ koala mapping, and planning scheme overlays (e.g. Biodiversity, Waterways & Wetlands). Some minor works are exempt under Queensland vegetation laws; others can proceed under an accepted development vegetation clearing code (with pre-clearing notification). If clearing is assessable under the planning scheme or not covered by a code/exemption, you’ll likely need a development approval.   • Queensland’s framework (Vegetation Management Act / Planning Regulation) regulates clearing using exemptions, accepted development codes and development approvals. The Sunshine Coast Planning Scheme adds local overlay controls (e.g. biodiversity corridors, waterways buffers) that can still make clearing assessable even if state rules say it’s exempt or code-assessable. You must comply with both systems: meet state requirements and satisfy any overlay benchmarks/approvals under the council scheme. All sounds a bit complicated?   • A Property Map of Assessable Vegetation (PMAV) is a certified, property-specific map that replaces the default state vegetation map for that lot. Landholders use PMAVs to correct mapping or confirm Category X areas (generally not regulated under the state vegetation framework — other laws may still apply). You can check if a PMAV exists and apply to create or amend one if needed. Whether you need it depends on your project’s certainty needs. The qualified arborists at ECTW will be able to assess your land and confirm if one is necessary, and help you get one.

  • “Exempt clearing work” is a defined list in Schedule 21 of the Planning Regulation 2017 (e.g. certain building works, routine property management, and some infrastructure maintenance) with strict conditions. Even if state law says it’s exempt, local planning overlays or other laws (e.g. koala controls, protected plants, marine plants) may still restrict clearing — so check everything before starting. For peace of mind, your best bet is to consult a land clearing contractor in Sunshine Coast, Brisbane, or Noosa, who will be experienced in your local regulations.

  • Since 7 February 2020, SEQ koala planning controls apply to mapped Koala Habitat Areas (KHA) and Koala Priority Areas (KPA). Some clearing is prohibited; other works are code-assessable against koala benchmarks. These controls operate alongside the vegetation framework — so a state exemption or code does not override koala rules.   • It depends on mapping, overlays and purpose. Clearing may be exempt, proceed under an accepted development code (with notification), or require a development approval. For example, clearing under a granted development approval can be treated as exempt clearing work under Schedule 21, but council overlay triggers may still apply.   • Expect extra constraints. The Sunshine Coast Planning Scheme’s Biodiversity, Waterways & Wetlands overlay sets buffers and outcomes to protect riparian areas and wetland values. Some works may be accepted for development with conditions; others need assessment and environmental management measures (sediment/erosion controls, rehabilitation). Our team will always check overlay maps and code provisions before starting.

  • Penalties can be significant, including fines and remediation orders. Sunshine Coast Council actively prosecutes unauthorised clearing and vegetation damage; recent local cases have resulted in sizeable fines. State agencies also prosecute offences under other Acts (e.g. marine plants). It’s always safer to confirm mapping and approvals before doing any clearing.
